1. Introduction

These Terms and Conditions ("Terms") govern the use of the ZenBooking website and platform operated by Zen Booking GmbH ("ZenBooking", "we", "us", or "our").

By using the ZenBooking website, submitting an enquiry, contacting a host, or otherwise interacting with listings on the platform, you agree to these Terms.

ZenBooking is a curated marketplace for unique venues and hospitality experiences. The platform enables users to discover venues, submit enquiries, and connect directly with hosts.

ZenBooking does not process payments, collect deposits, hold guest funds, or act as a party to any booking agreement. All bookings, payments, and contractual arrangements are made directly between users and hosts.

3. Definitions

  1. User means any individual or organisation using the platform to search for, enquire about, or book accommodation, venues, event spaces, retreat venues, wedding venues, corporate event venues, or other hospitality experiences.
  2. Host means the owner, operator, manager, or authorised representative of a venue listed on ZenBooking.
  3. Venue means any accommodation, hotel, retreat centre, wellness resort, estate, villa, event space, wedding venue, group accommodation, or other hospitality property displayed on the platform.
  4. Listing means any venue profile that offers accommodation, event space, or a hospitality experience published on ZenBooking.
  5. Booking Request means an enquiry, availability request, booking request, or other communication submitted by a User through the platform.

4. Nature of the Platform

  1. ZenBooking is a discovery and marketing platform.
  2. ZenBooking does not own, operate, manage, organise, sell, provide, or control any venue, accommodation, retreat, event, activity, or service displayed on the platform.
  3. ZenBooking is not a travel agency, tour operator, event organiser, accommodation provider, payment provider, or booking agent.
  4. All services displayed on the platform are provided directly by Hosts.

5. Listings and Information

Hosts are responsible for ensuring that all information displayed in their listings is accurate, complete, and up to date. This includes, but is not limited to:

  1. pricing;
  2. availability;
  3. accommodation details;
  4. venue facilities;
  5. services offered;
  6. photographs;
  7. special offers;
  8. cancellation policies;
  9. event or retreat information hosted at the venue.

While ZenBooking may review listings for quality and relevance, we do not guarantee the accuracy, completeness, availability, or suitability of any listing.

Users should verify all important information directly with the Host before confirming any booking.

6. Enquiries and Booking Requests

  1. Users may contact Hosts through enquiry forms available on the platform.
  2. Submitting an enquiry or booking request does not create a confirmed booking.
  3. A booking is only confirmed once it has been accepted and confirmed directly by the Host.
  4. Hosts are solely responsible for responding to enquiries, confirming bookings, and communicating booking details.
  5. ZenBooking does not guarantee response times, availability, prices, or booking confirmation.

7. Bookings and Payments

  1. ZenBooking does not process payments, collect deposits, hold guest funds, issue invoices, or handle refunds.
  2. All bookings are arranged directly between Users and Hosts.
  3. All payment terms, deposits, invoices, cancellations, refunds, and other contractual matters are agreed directly between the User and the Host.
  4. ZenBooking is not a party to any booking agreement and accepts no responsibility for payment transactions, refunds, cancellations, disputes, or the delivery of services.

8. Booking Contract

  1. Any booking contract is concluded exclusively between the User and the Host.
  2. ZenBooking is not a contractual party to such agreements and bears no responsibility for their performance.
  3. The Host is solely responsible for providing the booked services in accordance with their own terms, conditions, and policies.

9. Cancellations and Refunds

  1. Cancellation, modification, and refund policies are determined solely by the Host.
  2. Users should carefully review the applicable cancellation policy before confirming any booking.
  3. Any disputes regarding cancellations or refunds must be resolved directly with the Host.
  4. ZenBooking is not responsible for refund decisions, cancellation disputes, or changes to bookings.

10. User Responsibilities

Users agree to:

  1. provide accurate and complete information when submitting enquiries or booking requests;
  2. communicate respectfully with Hosts;
  3. comply with applicable laws and regulations;
  4. respect venue rules, house rules, and host policies;
  5. refrain from submitting false, misleading, fraudulent, or spam enquiries;
  6. use the platform only for lawful purposes.

ZenBooking reserves the right to restrict or block access to users who misuse the platform.

11. Intellectual Property

  1. All content on the ZenBooking website, including text, graphics, logos, design, software, and trademarks, is owned by or licensed to ZenBooking and protected by applicable intellectual property laws.
  2. No content may be copied, reproduced, distributed, modified, or used without prior written permission from ZenBooking, unless expressly permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, ZenBooking shall not be liable for:

  1. inaccuracies or outdated information in listings;
  2. acts or omissions of Hosts;
  3. booking cancellations or changes;
  4. payment disputes;
  5. refund disputes;
  6. venue closures;
  7. service interruptions;
  8. personal injury;
  9. property damage;
  10. financial loss;
  11. travel disruptions;
  12. disputes between Users and Hosts.

ZenBooking's liability is limited to the maximum extent permitted under applicable Swiss law.

13. Privacy

  1. The processing of personal data is governed by our Privacy Policy.
  2. By using the platform, you acknowledge that your personal information may be shared with Hosts for the purpose of responding to enquiries and facilitating bookings.

14. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Switzerland.
  2. Any dispute arising out of or in connection with these Terms or the use of the ZenBooking platform shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland, unless mandatory consumer protection laws provide otherwise.

15. Changes to These Terms

  1. ZenBooking may update these Terms from time to time.
  2. The current version will always be published on the website. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
